Terms of Service

These Terms of Service ("Terms") govern your access to and use of the Testola platform (the "Service"), which is provided by Testola ("Company," "we," "our," or "us"). By accessing or using Testola, you agree to comply with and be bound by these Terms. If you do not agree to these Terms, you must not use the Service.

1. Acceptance of Terms

By signing up for a Trial Account or using the Service, you acknowledge and agree to these Terms, which form a legally binding agreement between you and the Company.

2. Account Registration

To use Testola, you must create an account. When registering, you agree to:
  • Provide accurate, current, and complete information about yourself and your organization as requested during registration.
  • Maintain and promptly update your registration information to keep it accurate and complete.
  • Keep your account login information secure and confidential, and notify us immediately of any unauthorized access or use of your account.
  • Testola offers a 14-day free trial period. After the trial period, you will be required to select a paid plan to continue using the Service.


    3. Trial Account

    You may use the Service on a trial basis for 14 days ("Trial Period"). During the Trial Period, you can access and use all features available in your selected plan. Upon the expiration of the Trial Period, your account will be deactivated unless you subscribe to a paid plan.

    4. User Responsibilities

  • Content Creation : You are responsible for creating, uploading, and managing the content you use in assessments, including tests, questions, and assignments
  • Compliance: You agree that you will not use the Service for any illegal, harmful, or unauthorized purposes. You are solely responsible for ensuring that your use of the Service complies with applicable laws and regulations.
  • Prohibited Conduct: You agree not to engage in activities that may:
    • Violate any law, regulation, or third-party rights
    • Involve cheating, academic dishonesty, or fraud.
    • Interfere with the proper functioning of the Service, or harm or disrupt the experience of other users.

  • 5. Service Features

    Testola provides various features, including:
  • The ability to create, assign, and manage tests and assessments.
  • Bulk uploading of questions for tests.
  • Analyzing assessments and assignments.
  • Capturing images during assessments to monitor user activity and detect potential cheating.
  • Tracking user behavior, including mouse movements, multiple screens, and other security measures to prevent misuse during assessments.
  • You agree to the use of these features, and you consent to the collection of data, including images, screen activity, and user behavior, for security and assessment purposes.


    6. Data Security and Privacy

  • Data Storage: We take the security of your data seriously and use industry-standard encryption and data protection measures to safeguard your information.
  • User Data: You retain ownership of your content and data, but grant us a license to use it for providing and improving the Service.
  • Privacy Policy: For information on how we collect, use, and protect your personal data, please review our Privacy Policy, which is incorporated into these Terms by reference.

  • 7.Payment and Billing

  • After the Trial Period, you will be required to select a subscription plan and provide payment information.
  • Subscription fees are billed on a recurring basis, either monthly or annually, depending on your chosen plan.
  • You can cancel your subscription at any time before the next billing cycle to avoid future charges.Cancellations are effective at the end of the current billing period.
  • All fees are non-refundable, except as required by law.

  • 8. License Grant

    Subject to these Terms, we grant you a limited, non-exclusive, non-transferable license to access and use the Service for the duration of your subscription. This license is for personal, internal, non-commercial use only.

    9. Termination and Suspension

    We may suspend or terminate your access to the Service at any time if we determine, in our sole discretion, that you have violated these Terms or engaged in inappropriate conduct. Upon termination, you will lose access to your account, and your data may be deleted, subject to applicable laws.

    10. Limitations of Liability

    To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or loss of profits, data, or revenue, arising from your use or inability to use the Service.

    11. Indemnification

    You agree to indemnify, defend, and hold harmless the Company, its affiliates, and their respective employees, agents, and contractors from any and all claims, damages, liabilities, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or violation of these Terms.

    12. Modifications to the Service

    We may modify, update, or discontinue the Service at any time without notice. We will strive to provide prior notice of any significant changes to the Service, but you agree that we have no obligation to do so.
